Accident Victims' Bill of Rights

1. You have an absolute right to hire an attorney to represent you in your claim. Recently, some insurance companies have gotten in trouble with state regulators for telling consumers they're better off without a lawyer. The only ones who fare "better" are insurance companies - and they fare "better" at your expense. Insurance companies have professional adjusters representing their interests; you, too, have a right to representation.

2. You have only a limited time to make a claim. For many claims, the limit is two years. For some claims, it's as little as 60 days after injury. If a lawsuit is not filed within the permitted time, the statute of limitations may prohibit you from pursuing any claim you may have, no matter how bad your injury. If you don't wish to confer with us, therefore, we suggest that you consider discussing these issues with another lawyer, as soon as possible.

3. Until you talk to a lawyer, be careful who you talk to.

4. If you're hurt, follow your doctor's orders regarding follow-up treatment, work restrictions, and therapy. This is crucially important to your health, and it's important to your claim as well.

5. Finally, you should be aware of the effect "tort reform" advocates are having on your right to be compensated for your injuries. Unfortunately, the insurance industry and special interest groups, in their campaigns for so-called tort "reform" have, through myths and misinformation, poisoned the minds of ordinary citizens who make up the juries in this state. In our opinion, the propaganda distributed by organizations such as Citizens Against Lawsuit Abuse have made it difficult for victims of negligent conduct, such as yourself, to obtain fair compensation. It's even more difficult if you don't have experience fighting these battles.
