The types of employees who are entitled to overtime can be complicated, however, employees are generally entitled to overtime unless they fall into one of the following exceptions:

  • Administrative employees who do not do manual labor, whose primary duties involve general business operations and the exercise of discretion and independent judgment about matters of significance, and who are paid a salary of at least $455 per week;
  • Executive employees whose primary job duties are managing a division or subdivision of the company, directing the work of at least two employees with the authority to hire and fire, and who are paid a salary of at least $455 per week;
  • Professional employees whose work performance requires advanced knowledge, extensive education, innovation, creativity, or talent and who are paid a salary of at least $455 per week;
  • Outside sales employees whose primary duty is selling products or services away from the employer’s place of business;
  • Computer Systems Analysts paid a rate not less than $27.63 per hour and who design, develop, analyze, test, modify, or consult with users about computer systems and programs;
  • Certain agricultural employees;
  • Housekeepers, cooks, babysitters, and chauffeurs who provide domestic services and companionship;
  • Salespersons engaged in selling cars, trailers, boats or aircraft;
  • Highly paid employees earning at least $100,000 per year and who perform one or more of the above exempt jobs.

The laws also provide penalties for certain other wage and hour infractions such as failure to not pay minimum wage, and protection from retaliation for employees who file a complaint about not being paid overtime or minimum wage.
